Senator Wiener’s Statement on First Auto Burglary Case Charged Under New Law He Authored
SACRAMENTO – Today, District Attorney Brooke Jenkins announced charges in an auto burglary case that is the first in San Francisco to be charged under SB 905, a new law authored by Senator Scott Wiener (D-San Francisco). SB 905 eliminated the “locked door loophole,” a senseless requirement that prosecutors prove that a car door was locked — even when there were broken windows or other clear evidence of forcibly entry — in order to convict a suspect of auto burglary. The new law makes it easier for law enforcement to hold auto burglars accountable.
“Senseless requirements shouldn’t prevent law enforcement from holding the perpetrators accountable for brazen crimes like auto burglary,” said Senator Wiener. “SB 905 is already helping San Francisco’s top notch law enforcement better protect the community from this longstanding issue. I’m grateful for the work that SFPD and District Attorney Jenkins are doing to bring down auto break-in rates, and I’m glad the new tool is helping.”
